AnotationThe project treats the participation of minors in legal proceedings they are involved in. Participation, namely finding a child's opinion, is an integral part of determining the best interests of the child; the best interests of the child should be the primary consideration in each and every decision concerning the child. Czech legislation makes several ways of finding out the child's opinion possible; since the effective date of Act No. 89/2012 Coll., The Civil Code, it has been believed that children over 12 years of age are able to create and express their own opinion. In the Czech Republic, neither the way of identifying the child's opinion in relevant proceedings, nor taking his/her opinion into account in decisions which influence his/her further life, have been scientifically researched. The implementation the child's participatory rights is an integral part of respecting the principle of making decisions in accordance with the child's best interests, which is the primary consideration in all decisions concerning the child.The aim of the project is to find out whether and how opinions of underage children are inquired in legal proceedings which concern them and how the opinions are taken into account when making judicial decisions; the project will make use of a quantitative research strategy.
